The Environmental Protection Agency Board drafts and reviews all revisions and additions concerning standards contemplated for inclusion in the City's code. The EEPA shall forward all proposed revisions, additions and ordinances to City Council. City Council shall refer all ordinances concerning standards contemplated to the EPA Board for the board's review and refommendation.
The Board shall publish all notice of hearings.
Any person may appeal action of the Evansville EPA to the EPA Board. Appeals to the Board shall be initiated by filing a written appeal with the EEPA director specifying the grounds and the relief sought. The appeal shall be initiated within 30 days after the issuance of the decision, ruling, requirement, regulation or order or failure to act upon a proper application.
The EEPA shall furnish to the Board papers and other materials relating to an appeal. Not more than 10 working days after the date of receipt of filing, the Board shall give notice by mail to all interested parties of the datek time and place of a hearing on the appeal. The Board may, at its discretion, grant continuances. The appeal shall be a stay of the EEPA's action until final action by the Board. All hearings conducted by the Board shall be open to the pubic and conducted in accordance with Indiana Code.
If the EEPA Director has ordered a reduction in emissions or discontinuance of operations, the Board shall fix a place and time not less than 48 hours or more than 72 hours (excluding Saturdays, Sundays and legal holidays) thereafter for a hearing to be held before the Board. Not more than 24 hours after the commencement of such a hearing the Board shall affirm, modify or set aside the order of the EEPA Director.
